If there's one thing I learned from all my years as an NGO delegate to UN specialized agencies, it's that UN treaties are dangerous, liable to capture by unholy alliances of authoritarian states and rapacious global capitalists.
Most of my UN work was on copyright and "paracopyright," and my track record was 2:0; I helped kill a terrible treaty (the WIPO Broadcast Treaty) and helped pass a great one (the Marrakesh Treaty on the rights of people with disabilities to access copyrighted works):

It's been many years since I had to shave and stuff myself into a suit and tie and go to Geneva, and I don't miss it – and thankfully, I have colleagues who do that work, better than I ever did. Yesterday, I heard from one such EFF colleague, Katitza Rodriguez, about the Cybercrime Treaty, which is about to pass, and which is, to put it mildly, terrifying:

Look, cybercrime is a real thing, from pig butchering to ransomware, and there's real, global harms that can be attributed to it. Cybercrime is transnational, making it hard for cops in any one jurisdiction to handle it. So there's a reason to think about formal international standards for fighting cybercrime.
But that's not what's in the Cybercrime Treaty.
Here's a quick sketch of the significant defects in the Cybercrime Treaty.
The treaty has an extremely loose definition of cybercrime, and that looseness is deliberate. In authoritarian states like China and Russia (whose delegations are the driving force behind this treaty), "cybercrime" has come to mean "anything the government disfavors, if you do it with a computer." "Cybercrime" can mean online criticism of the government, or professions of religious belief, or material supporting LGBTQ rights.
Nations that sign up to the Cybercrime Treaty will be obliged to help other nations fight "cybercrime" – however those nations define it. They'll be required to provide surveillance data – for example, by forcing online services within their borders to cough up their users' private data, or even to pressure employees to install back-doors in their systems for ongoing monitoring.
These obligations to aid in surveillance are mandatory, but much of the Cybercrime Treaty is optional. What's optional? The human rights safeguards. Member states "should" or "may" create standards for legality, necessity, proportionality, non-discrimination, and legitimate purpose. But even if they do, the treaty can oblige them to assist in surveillance orders that originate with other states that decided not to create these standards.
When that happens, the citizens of the affected states may never find out about it. There are eight articles in the treaty that establish obligations for indefinite secrecy regarding surveillance undertaken on behalf of other signatories. That means that your government may be asked to spy on you and the people you love, they may order employees of tech companies to backdoor your account and devices, and that fact will remain secret forever. Forget challenging these sneak-and-peek orders in court – you won't even know about them:

Now here's the kicker: while this treaty creates broad powers to fight things governments dislike, simply by branding them "cybercrime," it actually undermines the fight against cybercrime itself. Most cybercrime involves exploiting security defects in devices and services – think of ransomware attacks – and the Cybercrime Treaty endangers the security researchers who point out these defects, creating grave criminal liability for the people we rely on to warn us when the tech vendors we rely upon have put us at risk.
This is the granddaddy of tech free speech fights. Since the paper tape days, researchers who discovered defects in critical systems have been intimidated, threatened, sued and even imprisoned for blowing the whistle. Tech giants insist that they should have a veto over who can publish true facts about the defects in their products, and dress up this demand as concern over security. "If you tell bad guys about the mistakes we made, they will exploit those bugs and harm our users. You should tell us about those bugs, sure, but only we can decide when it's the right time for our users and customers to find out about them."
When it comes to warnings about the defects in their own products, corporations have an irreconcilable conflict of interest. Time and again, we've seen corporations rationalize their way into suppressing or ignoring bug reports. Sometimes, they simply delay the warning until they've concluded a merger or secured a board vote on executive compensation.
Sometimes, they decide that a bug is really a feature – like when Facebook decided not to do anything about the fact that anyone could enumerate the full membership of any Facebook group (including, for example, members of a support group for people with cancer). This group enumeration bug was actually a part of the company's advertising targeting system, so they decided to let it stand, rather than re-engineer their surveillance advertising business.
The idea that users are safer when bugs are kept secret is called "security through obscurity" and no one believes in it – except corporate executives. As Bruce Schneier says, "Anyone can design a system that is so secure that they themselves can't break it. That doesn't mean it's secure – it just means that it's secure against people stupider than the system's designer":

But despite this, the idea that some bugs should be kept secret and allowed to fester has powerful champions: a public-private partnership of corporate execs, government spy agencies and cyber-arms dealers. Agencies like the NSA and CIA have huge teams toiling away to discover defects in widely used products. These defects put the populations of their home countries in grave danger, but rather than reporting them, the spy agencies hoard these defects.
The spy agencies have an official doctrine defending this reckless practice: they call it "NOBUS," which stands for "No One But Us." As in: "No one but us is smart enough to find these bugs, so we can keep them secret and use them attack our adversaries, without worrying about those adversaries using them to attack the people we are sworn to protect."
NOBUS is empirically wrong. In the 2010s, we saw a string of leaked NSA and CIA cyberweapons. One of these, "Eternalblue" was incorporated into off-the-shelf ransomware, leading to the ransomware epidemic that rages even today. You can thank the NSA's decision to hoard – rather than disclose and patch – the Eternalblue exploit for the ransoming of cities like Baltimore, hospitals up and down the country, and an oil pipeline:

The leak of these cyberweapons didn't just provide raw material for the world's cybercriminals, it also provided data for researchers. A study of CIA and NSA NOBUS defects found that there was a one-in-five chance of a bug that had been hoarded by a spy agency being independently discovered by a criminal, weaponized, and released into the wild.
Not every government has the wherewithal to staff its own defect-mining operation, but that's where the private sector steps in. Cyber-arms dealers like the NSO Group find or buy security defects in widely used products and services and turn them into products – military-grade cyberweapons that are used to attack human rights groups, opposition figures, and journalists:

A good Cybercrime Treaty would recognize the perverse incentives that create the coalition to keep us from knowing which products we can trust and which ones we should avoid. It would shut down companies like the NSO Group, ban spy agencies from hoarding defects, and establish an absolute defense for security researchers who reveal true facts about defects.
Instead, the Cybercrime Treaty creates new obligations on signatories to help other countries' cops and courts silence and punish security researchers who make these true disclosures, ensuring that spies and criminals will know which products aren't safe to use, but we won't (until it's too late):

9 Out-of-This-World Moments for Space Communications & Navigation in 2023

Liftoff was at 8:28 p.m. EST.
1. In November, we launched a laser communications payload, known as ILLUMA-T, to the International Space Station. Now, ILLUMA-T and the Laser Communications Relay Demonstration (LCRD) are exchanging data and officially complete NASA’s first two-way, end-to-end laser relay system. Laser communications can send more data at once than traditional radio wave systems – think upgrading from dial-up to fiber optic internet. ILLUMA-T and LCRD are chatting at 1.2 gigabits per second (Gbps). At that rate, you could download an average movie in under a minute.

NASA’s InSight lander captured this selfie on Mars on April 24, 2022, the 1,211th Martian day, or sol, of the mission.
2. Data analyzed in 2023 from NASA’s retired InSight Mars lander provided new details about how fast the Red Planet rotates and how much it wobbles. Scientists leveraged InSight’s advanced radio technology, upgrades to the Deep Space Network, and radio signals to determine that Mars’ spin rate is increasing, while making the most precise measurements ever of Mars’ rotation.

TBIRD is demonstrating a direct-to-Earth laser communications link from low Earth orbit to a ground station on Earth.
3. We set a new high record! The TeraByte InfraRed Delivery (TBIRD) payload – also demonstrating laser communications like ILLUMA-T and LCRD – downlinked 4.8 terabytes of data at 200 Gbps in a single 5-minute pass. This is the highest data rate ever achieved by laser communications technology. To put it in perspective a single terabyte is the equivalent of about 500 hours of high-definition video.

5. We are bringing humans to the Moon with Artemis missions. During expeditions, astronauts exploring the surface are going to need internet-like capabilities to talk to mission control, understand their routes, and ensure overall safety. The space comm and nav group is working with international partners and commercial companies to develop LunaNet, and in 2023, the team released Draft LunaNet Specification Version 5, furthering development.

The High-Rate Delay Tolerant Networking node launched to the International Space Station in November and will act as a high-speed path for data.
6. In addition to laser communications, ILLUMA-T on the International Space Station is also demonstrating high-rate delay/disruption tolerant networking (HDTN). The networking node is showcasing a high-speed data path and a store-and-forward technique. HDTN ensures data reaches its final destination and isn’t lost on its path due to a disruption or delay, which are frequent in the space environment.

The Communications Services Project (CSP) partners with commercial industry to provide networking options for future spaceflight missions.
7. The space comm and nav team is embracing the growing aerospace industry by partnering with commercial companies to provide multiple networking options for science and exploration missions. Throughout 2023, our commercialization groups engaged with over 110 companies through events, one-on-one meetings, forums, conferences, and more. Over the next decade, NASA plans to transition near-Earth services from government assets to commercial infrastructure.

8. Every year, NASA’s Office of STEM Engagement sponsors the App Development Challenge, wherein middle and high school students must solve a coding challenge. This year, student groups coded an application to visualize the Moon’s South Pole region and display information for navigating the Moon’s surface. Our space communications and navigation experts judged and interviewed students about their projects and the top teams visited NASA’s Johnson Space Center in Houston!

9. The Near Space Network supported 19 launches in 2023! Launches included Commercial Crew flights to the International Space Station, science mission launches like XRISM and the SuperBIT balloon, and many more. Once in orbit, these satellites use Near Space Network antennas and relays to send their critical data to Earth. In 2023, the Near Space Network provided over 10 million minutes of communications support to missions in space.

The Chicago Park District is seeking an experienced candidate to join our Natural Areas team, a part of the Park District’s Department of Cultural and Natural Resources. The Special Projects Assistant will be a member of the Rethinking Lawns project, a multi-disciplinary team exploring the ecological and ecosystem services benefits of traditional lawns, natural areas, and native, short-statured lawn replacement plantings. The ideal candidate will have experience in project coordination and ecological field work, preferably in a leadership capacity.
Key responsibilities include leading a team of seasonal research assistants in collecting data on plant cover, pollinator visitation, water infiltration, temperature, and soils at sites throughout Chicago and at the Chicago Botanic Garden. The Special Projects Assistant will participate in regular project coordination meetings with the research team, and oversee scheduling, coordination, communication, and data entry. They will also regularly interact with landscaping contractors, colleagues and the project team regarding installation and maintenance of plantings. Exceptional candidates will have some experience in data management, and analysis using R, and/or GIS. There are opportunities to present at local and national conferences. Local travel to field sites is required.
Desired Qualifications:
Bachelor's degree in Biology, Environmental Science, or a related field, or a combination of education and experience.
Knowledge of ecological principles and practices.
Ability to research information and prepare clear written or oral reports.
Ability to relate to field personnel and community groups, particularly in an urban setting.

One of President-elect Trump’s campaign pledges was to eliminate the Department of Education. He claimed that the department pushes “woke” ideology on America’s schoolchildren and that its employees “hate our children.” He promised to “return” education to the states. 
In fact, the Department of Education does not set curriculum; states and local governments do. The Department of Education collects statistics about schools to monitor student performance and promote practices based in evidence. It provides about 10% of funding for K–12 schools through federal grants of about $19.1 billion to high-poverty schools and of $15.5 billion to help cover the cost of educating students with disabilities.
It also oversees the $1.6 trillion federal student loan program, including setting the rules under which colleges and universities can participate. But what really upsets the radical right is that the Department of Education is in charge of prohibiting discrimination on the basis of race and sex in schools that get federal funding, a policy Congress set in 1975 with an act now known as the Individuals with Disabilities Education Act (IDEA). This was before Congress created the department.
The Department of Education became a stand-alone department in May 1980 under Democratic president Jimmy Carter, when Congress split the Department of Health, Education, and Welfare into two departments: the Department of Health and Human Services and the Department of Education. 
A Republican-dominated Congress established the Department of Health, Education, and Welfare in 1953 under Republican president Dwight D. Eisenhower as part of a broad attempt to improve the nation’s schools and Americans’ well-being in the flourishing post–World War II economy. When the Soviet Union beat the United States into space by sending up the first  Sputnik satellite in 1957, lawmakers concerned that American children were falling behind put more money and effort into educating the country’s youth, especially in math and science. 
But support for federal oversight of education took a devastating hit after the Supreme Court, headed by Eisenhower appointee Chief Justice Earl Warren, declared racially segregated schools unconstitutional in the May 1954 Brown v. Board of Education decision. 
Immediately, white southern lawmakers launched a campaign of what they called “massive resistance” to integration. Some Virginia counties closed their public schools. Other school districts took funds from integrated public schools and used a grant system to redistribute those funds to segregated private schools. Then, Supreme Court decisions in 1962 and 1963 that declared prayer in schools unconstitutional cemented the decision of white evangelicals to leave the public schools, convinced that public schools were leading their children to perdition.
In 1980, Republican Ronald Reagan ran on a promise to eliminate the new Department of Education.
After Reagan’s election, his secretary of education commissioned a study of the nation’s public schools, starting with the conviction that there was a “widespread public perception that something is seriously remiss in our educational system.” The resulting report, titled “A Nation at Risk,” announced that “the educational foundations of our society are presently being eroded by a rising tide of mediocrity that threatens our very future as a Nation and a people.”
Although a later study commissioned in 1990 by the Secretary of Energy found the data in the original report did not support the report’s conclusions, Reagan nonetheless used the report in his day to justify school privatization. He vowed after the report’s release that he would “continue to work in the months ahead for passage of tuition tax credits, vouchers, educational savings accounts, voluntary school prayer, and abolishing the Department of Education. Our agenda is to restore quality to education by increasing competition and by strengthening parental choice and local control.”
The rise of white evangelism and its marriage to Republican politics fed the right-wing conviction that public education no longer served “family values” and that parents had been cut out of their children’s education. Christians began to educate their children at home, believing that public schools were indoctrinating their children with secular values. 
When he took office in 2017, Trump rewarded those evangelicals who had supported his candidacy by putting right-wing evangelical activist Betsy DeVos in charge of the Education Department. She called for eliminating the department—until she used its funding power to try to keep schools open during the covid pandemic—and asked for massive cuts in education spending.
Rather than funding public schools, DeVos called instead for tax money to be spent on education vouchers, which distribute tax money to parents to spend for education as they see fit. This system starves the public schools and subsidizes wealthy families whose children are already in private schools. DeVos also rolled back civil rights protections for students of color and LGBTQ+ students but increased protections for students accused of sexual assault. 
In 2019, the 1619 Project, published by the New York Times Magazine on the 400th anniversary of the arrival of enslaved Africans at Jamestown in Virginia Colony, argued that the true history of the United States began in 1619, establishing the roots of the country in the enslavement of Black Americans. That, combined with the Black Lives Matter protests in 2020, prompted Trump to commission the 1776 Project, which rooted the country in its original patriotic ideals and insisted that any moments in which it had fallen away from those ideals were quickly corrected. He also moved to ban diversity training in federal agencies. 
When Trump lost the 2020 election, his loyalists turned to undermining the public schools to destroy what they considered an illegitimate focus on race and gender that was corrupting children. In January 2021, Republican activists formed Moms for Liberty, which called itself a parental rights organization and began to demand the banning of LGBTQ+ books from school libraries. Right-wing activist Christopher Rufo engineered a national panic over the false idea that public school educators were teaching their students critical race theory, a theory taught as an elective in law school to explain why desegregation laws had not ended racial discrimination. 
After January 2021, 44 legislatures began to consider laws to ban the teaching of critical race theory or to limit how teachers could talk about racism and sexism, saying that existing curricula caused white children to feel guilty.
When the Biden administration expanded the protections enforced by the Department of Education to include LGBTQ+ students, Trump turned to focusing on the idea that transgender students were playing high-school sports despite the restrictions on that practice in the interest of “ensuring fairness in competition or preventing sports-related injury.” 
During the 2024 political campaign, Trump brought the longstanding theme of public schools as dangerous sites of indoctrination to a ridiculous conclusion, repeatedly insisting that public schools were performing gender-transition surgery on students. But that cartoonish exaggeration spoke to voters who had come to see the equal rights protected by the Department of Education as an assault on their own identity. That position leads directly to the idea of eliminating the Department of Education.
But that might not work out as right-wing Americans imagine. As Morning Joe economic analyst Steven Rattner notes, for all that Republicans embrace the attacks on public education, Republican-dominated states receive significantly more federal money for education than Democratic-dominated states do, although the Democratic states contribute significantly more tax dollars. 
There is a bigger game afoot, though, than the current attack on the Department of Education. As Thomas Jefferson recognized, education is fundamental to democracy, because only educated people can accurately evaluate the governmental policies that will truly benefit them.
In 1786, Jefferson wrote to a colleague about public education: “No other sure foundation can be devised for the preservation of freedom, and happiness…. Preach, my dear Sir, a crusade against ignorance; establish and improve the law for educating the common people. Let our countrymen know that the people alone can protect us against [the evils of “kings, nobles and priests”], and that the tax which will be paid for this purpose is not more than the thousandth part of what will be paid to kings, priests and nobles who will rise up among us if we leave the people in ignorance.”
